These Terms and Conditions ("Agreement") govern the participation in the Workation program ("Program") organized by Anouk Pruijn ("Organizer"), a business entity located in the Netherlands. By purchasing the Program, participants ("Participants") agree to abide by the following terms and conditions.
1.1. "Participant" refers to a natural person who does not represent a company or an individual or organization that does have a company or business and uses the services of the Organizer.
1.2. "Agreement" refers to the binding agreement between the Organizer and the Participant, whereby the Organizer commits to providing services and the Participant commits to paying a fee for this. The agreement arises through an offer from the Organizer and its acceptance.
1.3. "Services" refers to all products and services that the Organizer and/or its partners provide to the Participant, including but not limited to organizing retreats, as well as all other activities that the Organizer carries out for the benefit of the Participant.
1.4. "Website" refers to the online presence at https://locationindependent.life/.
2.1. These general terms and conditions apply to every offer from the Organizer and to all existing and future agreements, deliveries, business relationships, and other legal connections between the parties involved.
2.2. The Participant's terms are explicitly rejected. Deviations from these general terms and conditions are only valid if expressly and in writing agreed upon with the Organizer.
2.3. These general terms and conditions also apply to additional or modified assignments from the Participant.
2.4. If one or more provisions in these General Terms and Conditions are found to be invalid, this does not affect the validity of the remaining provisions and the entire agreement. In that case, the parties will endeavor to replace the invalid provision with a new, valid provision that closely matches the intent of the original General Terms and Conditions.
3.1. All prices are quoted and payable in Euro. The Organizer is not responsible for any fees incurred due to currency exchange or fees charged by your credit card/bank for processing funds in another currency.
3.2. The Organizer reserves the right to alter the prices of any of the travel arrangements shown on the website. Participants will be advised of the current price of the travel arrangement they wish to book before their contract is confirmed.
3.3. A non-refundable deposit of €350 is required to secure a place in the Program. This deposit must be paid at the time of booking.
3.4. The remaining balance of the Program fee must be paid no later than 30 days before the start of the Program. If the full payment is not received by the due date, the Organizer reserves the right to cancel the Participant's booking and retain the non-refundable deposit.
3.5. Not included in the price of the Program arrangement is flights, transport, travel insurance, excess baggage charges, tipping and any food or drink or additional excursions or activities which are not confirmed as being part of the Program. Additionally, any items or services purchased during the Program are not included in the cost of Participant’s travel arrangement unless specifically stated.
4.1. We understand that unexpected events can arise that can affect your plans. Cancellations made more than 30 days before the start of the Program will receive a refund of any payments made, minus the non-refundable deposit of €350.
4.2. Cancellations made 30 days or less before the start of the Program will not be eligible for any refund.
4.3. If the Participant fails to join the Program, arrives late, or leaves early for any reason, no refunds will be provided.
5.1. The Program includes accommodation in Panama for the duration specified in the booking confirmation.
5.2. The Program does not include transportation to and from Panama, meals, travel insurance, personal expenses, or any other services not explicitly mentioned as included.
5.3. Participants are responsible for arranging their own travel and ensuring they have valid travel documents, including passports and visas if required.
6.1. Participants must comply with all local laws and regulations in Panama. Participants acknowledge they may be visiting places where the political, cultural and geographical attributes present certain risks, dangers and physical challenges greater than those present in their daily life. By booking this Program, the Participant acknowledges they have considered the potential risks, dangers and challenges, and expressly assumes the risks attendant to such travel conditions. The Participant is solely responsible for acquainting themselves with customs, weather conditions, physical challenges, and laws in effect at each stop along the itinerary, and is encouraged to locate or make contact prior to embarkation with their local embassy or consulate at the Program destination.
6.2. Participants are responsible for their own safety and well-being. The Organizer is not liable for any injury, loss, or damage sustained during the Program.
6.3. Participants must respect the property and privacy of others and adhere to the accommodation rules and policies.
6.4. Participants must inform the respective guide/coach/host of any physical complaints or special needs.
7.1. Participants acknowledge that Panama is subject to tropical storms and adverse weather conditions, which can impact the Program.
7.2. The Organizer will make reasonable efforts to minimize disruptions caused by weather, but is not responsible for any changes to the Program itinerary or activities due to weather conditions.
7.3. In the event of a natural disaster or severe weather that requires cancellation or modification of the Program, the Organizer will not be liable for any loss or damage incurred by the Participant.
8.1. The Organizer's liability is limited to the amount paid by the Participant for the Program.
8.2. The Organizer is not liable for any indirect, consequential, or incidental damages arising out of or in connection with the Participant's participation in the Program.
8.3. Hotels/accommodation, shuttle services, excursions or other elements of the Program may be arranged by the Organizer with local suppliers who may themselves engage the services of local operators and/or sub-contractors. The terms and conditions of the suppliers will be applicable. These may limit or exclude the liability of the supplier. Neither the Organizer nor any carrier is liable for independent contractors.
9.1. The Organizer reserves the right to amend or update these Terms and Conditions at any time without prior notice.
9.2. Participants will be notified of any significant changes to these Terms and Conditions.
10.1. It is mandatory for Participants to take out health, accident, and travel insurance. It is strongly recommended to also arrange cancellation insurance, especially for activities abroad.
10.2. All costs incurred due to non-compliance with these obligations are entirely the responsibility of the Participant.
11.1. Participation in the Program during the Workation is voluntary. Non-participation does not entitle the Participant to a partial refund of the amount paid.
11.2. Participation in the activities during the Workation is at the Participant's own risk. These activities are not intended as a substitute for therapy but as recreation and personal growth.
11.3. Participants are responsible for informing the respective guide/coach/host of any physical complaints.
11.4. The use of narcotics and excessive alcohol consumption is not permitted throughout the entire Workation.
11.5. The Organizer expects respectful behavior from all Participants towards each other.
11.6. Participants should treat the environment and locations with care. Any damages will be recovered from the responsible party.
11.7. In the course of participation in the Program, photos or video may be taken by participants, guides and professional photographers. These images may be used in any promotional materials, website, all social media platforms (i.e. Instagram), etc., unless the Participant specifically requests the photographer or in writing to the Organizer, to not use any material your image is depicted in. Otherwise, permission is granted to the Organizer to perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.
11.8. Failure to comply with the rules described in this article may result in the removal of the Participant from the Workation. In that case, the Participant is not entitled to a refund of payment.
12.1. The Participant is responsible for providing accurate and relevant information necessary for the execution of the Agreement. The Organizer cannot be held liable for damages resulting from incorrect or irrelevant information provided by the Participant.
12.2. The Organizer is not responsible for errors or omissions by third parties it has engaged. By using the services of the Organizer, the Participant agrees that the Organizer accepts on their behalf the liability limitations of third parties.
12.3. The Organizer is not liable for injuries during activities of the Workation, nor for loss or damage to the Participant's property. It is strongly recommended to take out comprehensive travel insurance.
12.4. The Participant must be adequately insured against damage they themselves or third parties may suffer as a result of their participation in the Workation. The Participant participates in the Workation at their own risk and indemnifies the Organizer from all liability for damage to third parties arising from their actions or omissions.
12.5. The liability of the Organizer is limited to the amount covered and paid out by the insurer. If no payout occurs or if the Organizer is not insured, the liability is limited to the amount paid by the Participant.
12.6. This limitation of liability does not apply in case of intent or gross negligence on the part of the Organizer, nor to the extent that liability cannot be limited by law.
13.1. This Agreement is governed by and construed in accordance with the laws of the Netherlands.
13.2. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
14.1. By purchasing the Program, the Participant acknowledges that they have read, understood, and agreed to these Terms and Conditions.
